Preamble
1. “EDMI” Limited Liability Company, on the one hand, offers any natural or legal person, on the other hand, to enter into this public contract on the terms set forth below.
Definition of terms
2. An offer is a public offer to enter into an electronic sales contract.
3. Acceptance – acceptance by the Buyer of the Seller’s offer to purchase the Goods, the assortment and detailed information about which is contained on the website https://edmi-com-ua.tesovii.space/, by adding it to the virtual cart and ticking the appropriate column about acceptance conditions of the offer (offer).
4. The contract is this public contract, a sample of which is posted on the website, https://edmi-com-ua.tesovii.space/, which contains the Seller’s offer to purchase the Goods, the assortment and detailed information about which is available on the website https:// edmi-com-ua.tesovii.space/, aimed at an undefined circle of people.
5. Order – a properly executed application of the Buyer for the purchase of Goods addressed to the Seller.
6. The buyer is any able-bodied individual, legal entity, individual entrepreneur who has visited the website https://edmi-com-ua.tesovii.space/ and intends to purchase one or another Product.
7. The seller is “EDMI” Limited Liability Company.
8. The website is https://edmi-com-ua.tesovii.space/.
9. Goods – medical, dental instruments and materials and other goods offered for sale, in accordance with the assortment and prices indicated on the Site. The goods may be available to the seller at the time of concluding the contract or will be created (purchased, acquired) by the seller in the future. Terms
10. This Agreement is a public agreement, in accordance with Art. Art. 633, 641 of the Civil Code of Ukraine. The terms of the Agreement are the same for all Buyers, and unconditional acceptance of the terms of this Agreement is considered acceptance of this offer by the Buyer.
11. This Agreement is an accession agreement, the terms of which are set out in the Offer, which can be concluded only by the Buyer joining the terms proposed in the Offer.
12. This Agreement is an electronic agreement.
13. This Agreement is concluded on the basis of and is regulated by the Civil Code of Ukraine, the Economic Code of Ukraine, the Law of Ukraine “On Electronic Commerce”, the Law of Ukraine “On Copyright and Related Rights”, the Law of Ukraine “On Protection of Consumer Rights” (if applicable to the relations of the Parties ), and other applicable legislative acts of Ukraine.
14. Pursuant to the requirements of Article 7 of the Law of Ukraine “On Electronic Commerce”, the Seller informs that the location of the Seller is: 76018, Ivano-Frankivsk Region, Ivano-Frankivsk City, Konovaltsia Evgena Street, Building 229. Identification code of the legal entity (Seller) – 43942710. The full name of the legal entity of the Seller is EDMI Limited Liability Company. Subject of the Agreement
15. Under this Agreement, the Seller undertakes, on the terms and in the manner specified by this Agreement, to transfer the Goods based on the Order issued by the Buyer, and the Buyer undertakes, on the terms and in the manner specified by this Agreement, to receive the Goods and pay the Buyer its value .
Order processing procedure. Terms of delivery and receipt of goods
16. The Buyer places the Order on the Seller’s Website.
17. To place an Order, the Buyer must: select the Products posted on the Site, their quantity, and press the appropriate button to purchase the Product, the Product will be automatically added to the “Cart” section; confirm the Order and fill in the data in the appropriate electronic Order form, choose the method of payment and delivery of the Goods.
18. Payment for the Goods is accompanied by the electronic signature of the Licensee with a one-time identifier.
19. The Order is considered completed and accepted for execution by the Seller after the Seller sends the confirmation of the Order to the Buyer’s e-mail address specified when placing the Order.
20. The Goods are delivered in the manner chosen by the Buyer when placing the Order. If the Buyer chooses delivery of the Goods by courier within the city of Ivano-Frankivsk, the delivery is free of charge. Delivery by third-party carriers with whom the Seller cooperates is carried out at the rates of the relevant carrier, the cost of delivery is paid by the Buyer.
21. The delivery of goods is carried out throughout Ukraine, but may be limited due to the lack of appropriate capabilities of third parties providing delivery services, weather conditions, and other circumstances beyond the control of the Buyer.
22. The buyer or his representative, upon receipt of the goods at the delivery service or by courier, confirms with his signature on the consignment note that he has no complaints about the quantity of the goods, appearance and completeness of the goods, and confirms the fact of the transfer of ownership of the goods to the buyer.
23. The buyer bears full responsibility for the correctness and reliability of the data specified by him when placing the Order.
